Figure 1 — Immigration legislation, regulations and policy

 

Primary legislation, the Immigration Act of 1987, is the focus of this review. The primary legislation provides the framework for immigration decision-making and establishes key powers and obligations, including the power of the Minister to make immigration policy.

Secondary legislation, the Immigration Regulations of 1999, is driven by the content of the Immigration Act of 1987. Secondary legislation provides the technical detail on the rules and processes for applications and establishes the specific requirements for enforcing provisions of the Act.

Policy, both strategic and operational, are outside the scope of this review. Such policies include high-level decisions made by Cabinet (such as the numbers and types of residence places available each year) and criteria and rules for residence and temporary entry.
