Under Option B, a single opportunity exists to contest liability for expulsion on the facts. This is followed by either:
- departmental assessment for short-term temporary entrants, those without a sponsor and those who do not access appeal, or
- an independent humanitarian appeal for residents and temporary entrants with a sponsor or who have lived in New Zealand lawfully for at least to years.
