Anonymous complaints about health and safety

Can an employee make an anonymous complaint about health and safety practices?

Yes, an employee does not need to reveal their name when notifying the Department of Labour about a health and safety matter that concerns them. However, if the complaint is anonymous, it is more difficult for the Department to undertake a comprehensive investigation. This is because:

  • Depending on the situation, it may not be possible to take enforcement action or bring a prosecution against the employer without the employee's evidence.
  • If the complaint is investigated, it may become obvious to an employer and others that the investigation was prompted by a particular complaint.
  • By making an anonymous complaint, the Department is also unable to check back with the employee, or update them with developments.

Employees raising concerns directly with employers may achieve a quicker and more positive outcome and where there is risk of harm, this can be done formally using a hazard notice.
